bruceThe date of occurrence to date of conviction is being interpreted to be the shortest of the two for determining the 10 year period in Alaska for dui misdemeanor or felony. I would think date of occurrence to date of occurrence would be used. Or at least date of conviction to date of conviction would be used. Why are the courts getting away with determining dates in this unscrupulous manner? The courts set the court date so I would think doo to doo would be the only correct interpretation. Any help on this one!!!!!!!
brianif you beat the case entirely, you most likely will keep your license to carry. brian@hlzlaw.com
Legal gun ownerI was arrested a few weeks ago for simple assault. Here's what happened.
I was driving to a doctor appointment and had stopped at a stop sign. A younger male was crossing the street and had stopped in the middle of the street and stared at me. I beeped my horn and told him to hurry up. At that time he put his hand in his coat pocket and started to approach my passenger side window. Not knowing what he had and being a legal gun owner with a license to carry placed my hand on the grip of my pistol. He came up to my window and started to ask if I was a tough guy and for me to get out and fight him. I told him to "fuck off" and to step away from my car. At that point he looks down and sees my hand on my pistol, he then told me I was lucky and walked away.
Fast forward about an hour and a half, I exit the doctor's office and get back in to my car. At that time I'm swarmed by 5 or 6 police cars and ordered out of my vehicle at gun point. They tell me that someone called and told them I pulled my gun on them and threatened to blow their brains out. I of course told them that was bullshit and wouldn't risk my 2nd amendment over some punk with an attitude. I fully cooperate with the officers with their questions, ie: where's the gun, do I have an more weapons in the car etc.
I was taken in to custody and booked at Northeast detectives, spent 20 hours in a cell and bailed out at 10% of $10,000.
My questions are this. What are the chances of me getting out of this? After all it's his word verses mine. Also, if found not guilty, what are the chances of me being able to get my license to carry back? This is a total headache and it's going to be expensive to get a lawyer to defend me (I was quoted $2500 by a couple of lawyers).

maxi789I had been drinking. Not sure how much. I didn't think I was drunk. I made a u-turn and thought I would get pulled over by the nearby cops. So, I pulled into a Best Buy parking lot and ran my ass off. In the mail several days later I got all kinds of tickets and a charge of evading. My question is: Can I get arrested for DUI? Can I fight these tickets?
