Hi Mary Beth,

Wow, I did not know that the government could take collected child support arrears to support their collection programs. I did know that if you have recieved public assistance, then they can remiburse themselves with the collected child support.
I am defintely going to look into this and find out more information. Please let me know what you come up with.

Hi Christina. Thanks for replying to me, and yes you are right about arrears owed, they are supposed to be owed to the custodial parent. However in my case when my child did became emancipated (which is my oldest child) In the recent past of June, I received a letter from the State saying all this back child support money and it stated the amount which has been lowered from itâ??s original $17,625.80 has now been lowered to $14,279.05 b/c the State did indeed collect my back child support money all without a notice to me first. When I first opened this very bad piece of mail, you can imagine how horrified I was to see this in black and white. Then it stated you have the right to an Appeal, which of course I am appealing....ugh and what a headache this is to me now....trying to find a lawyer who will actually want to take my case....but I am trying....I have been working as a legal secretary for the last seven years and previously b/f the firm I work at now I was working at a Financial firm. I was in college when my kids were babies/toddlers and just b/c I collecting â??someâ?? assistance way back a long long time ago, the State now believes that all this significant back child support money of $17,625.80 is all owed to Them and â??Oâ?? zero amount is owed to me the custodial parent. Keep in mind the accrual time of my child support was All While I Was Working and she was indeed a small child. But How In The World Can the State Come Back From The Dead and Collect This!!! I was told that is why they deliberately sit on your case and wait for the child to become 18 yr. , to make it look good they may wait unit 19 yrs. or 20 yrs. old, just so it doesnâ??t look obvious. They even do this to the custodial parent even if she or he Never Ever collected a dime of public assistance. There is another program out there called the Amnesty Program, and people especially mothers will THINK this is a great program when really, what they are doing is taking their driving license away, the pass ports, bench warrants for their arrest, liens on property like you were saying, however when they get a bunch of deadbeats that are in significant arrears NONE of this money is being directed to the families, it is all going back into the System!!!! and Why because they claim itâ??s to Support the â??Amnesty Programâ?? I did my homework on this one and I researched and it is happening in every single state. Earlier I was like you I thought it was just b/c they; domestic relation enforcement unit were lazy.....but my hunch is that all Women are going to be in the Shock of Their Life when their child reaches of Age....Unfortunately.....it just hasnâ??t been to these women yet.....and Iâ??m afraid it will.....as matter of fact I know it will....And This Does Indeed Make Me Mad! And someone needs to blow the whistle on this! I hope to God it doesnâ??t happen to you Christina.....and hopefully the laws will change by then....I am working hard on this. Thank you so much for your help and letting me vent a little...I love your blog it is so pretty and I can tell you are very informative with your knowledge on this matter....any feedback from you would greatly be appreciated. Hi Mary Beth,
The state cannot hold child support arrears that is owed to a custodial parent just because the child has reached 18 years old.
The problem with these government agencies is that they are overwhelmed with many cases and the old adage "out of site, out of mind" applies. If you are not actively calling them and getting on their case weekly, your case can go unnoticed.
The key is to be a pest and stay in contact with the case worker assigned to your case. Ask them to search bank account records, garnish wages and even put liens on any property you may find that your ex owns.
Although it takes energy and time, if you are proactive and give the state agency any information you may have about your ex, you have a better chance of collecting the child support that is owed.

I like what you have to say...and you are right you probably do have to do some of your own homework....but the trouble I keep finding with my matter is, once the child reaches 18 yrs. of age and you are still owed a significant amount in child support arrears, what happens is the State and these “Enforcement Agencies” are deliberately procrastinating enforcement during the accrual time when the child is still a minor. That’s b/c it is advantageous for the State to “sit on a case” and let the deadbeat get into significant arrears and do nothing until the child is of age so the State can then retain all of your back child support money....of course the State will say it’s to support “these programs” instead of redirecting the money to the family or mother and/or father that is owed. But that is okay there are Laws to protect us in this matter if the State ever happens to do this to the custodial parent. Any of your views would be helpful. Anyone else out there with this problem? Please write back...and hopefully we can be guided to help.
