I was escorted to the back room of Wal Mart because I broke the machine you swipe your card in, and was accosted by three men at once, causing traumatic brain injury. Against Wal Mart rules, they had no cameras in this back room,and I had no witnesses, as I felt safe in Sam Walton's store (He'd turn over in his grave if he knew how bad his empire has fallen from His dream) I went back to pay for the machine, everyone agreed it was an accident. The head of loss prevention showed a badge from under his shirt and said "any question as to who I am?" Stunned that they called the police, and more stunned they got there so soon, he escorted me to the back (at this time I'd like to state I am a paraplegic, and can not get around without the use of a wheelchair). After being threatened with his Jiu Jitsu, I finally realized the situation I was in. The three men attacked me, I cracked my head (EMTs confirmed this, but I waited for police after they said if I had a hematoma burst, it would have already happened. When the officers arrived, it was like an old army buddies' reunion, I knew I was screwed. The man with the badge was the loss prevention specialist, posed as a cop, the real cops drummed up 12 people, some I had no contact with up to that point, and got them to fill out "voluntary statements", which I was not allowed to do. The Customer Service lady had rang up an amp I planned to purchase with my returns as if I were trying to return it, so they tried to get me with burglary; the cop said "I'm not going to stack charges on this guy like that" and then quietly muttered "just be glad he's the only one going to jail." He knew they had used excessive force, I had a solid case, at preliminary trial, my public pretender was able to get him to admit he knew Jiu Jitsu, something I could not have known unless he did what he did (threaten me). He also broke my cell phone when, after 2+ hours, I realized they had not called the cops and I tried to call them, but the cop refused to put it in evidence, as they were all lying, saying they had no idea how it got broken. Wal Mart has big bucks to get their way, and I had a PD paid by the state and was fighting for justice as I knew I had done nothing illegal and was being not only framed, but denied the right to the video that would have proven they used excessive force. Part II-- My PD let them ream me, and in spite of this being my first brush with the law and P&P recommending probation, the judge sentenced me to 4 years in Prison!! He did not make sure the jails and prisons were in compliance with the Federal Americans with Disabilities Act Law (ADA), which they weren't, and my serious medical needs went unmet while there. I got out after a little over a year with a "fast track appeal", even though the PD that handles appeals refused all the points I had against my first PD for ineffective counsel. When I say my Serious Medical Needs went unmet, I mean not only did they refuse to do anything to treat my Chronic Severe Spasms and Chronic Severe Pain, but also I was denied Durable Medical Equipment and supplies I require to move my bowels, one time for six days, one for five days, another for ten days (Plus twice in Jail for ten days at a time)and my near death experience at 12 days. Unlike the Wal Mart incident where I had no eyewitnesses besides WM employees lying to keep their sorry little jobs, in Jail and in Prison I maintained a solid paper trail of exactly what was happening. I was arrested on December 20 of 2006, so the statute of limitations would have run out, save for the law about the limitations clock does not toll while I am incarcerated, which added over a year on to the two year statute. The prison/jail situation went from that time to August of 2007 when I was finally released (Although my case was reversed and remanded on the burglary charge, I was forced to sign a plea in order to get out of jail, where once again, I had been forced to go over 6 days without a BM, they refused to get me to the hospital for emergency disimpaction, so under threat, duress, and coercion, I signed a plea to consiracy to commit burglary. Long story, and this is not even the half of it, but I don't want to go on. Needless to say, I feel I owe it to other disabled prisoners to help get the prison systems (This happened in Las Vegas, Nevada) to meet their legal obligation under the ADA. "Don't just get out and forget about what they did to you, and don't forget about what we have to go through every day too....everyone says they're going to do something,but they never do. Don't you forget us and just leave us here to suffer. Sure, we don't have it anywhere near as bad as the bullsh*& they put you through, but they need to meet the law, because I'm sick of falling every time I take a shower and all the other cra*." I told them I would follow through,and I want to keep that promise, but I waited until I left the state to avoid retaliation, and am trying to get my health back (physical and mental), get my life back on track, and am not having much luck in finding an attorney licensed in the State of Nevada willing to take on the State (they do have to live there, and don't like retaliation either), much less take on the world's largest corporation and all their money, so long after it happened. Yet, I believe that can be a benefit, as perhaps maybe some of the twelve perjurers are now disgruntled EX WM employees, willing to recant their choreographed statements and finally tell the truth. I also know a detached attorney (this silly little case sure did draw a lot of attention; one attorney I contacted from a recommendation told me all about my case. How'd he know so much? The DA had divulged this information to him) would see the opportunity to make good money on this case, as well as make a name for himself. I guess I'm asking for anyone who reads this blog (especially if you've read this far) to help me! If anyone knows a hungry young lawyer that believes in doing what's right, and is willing to relocate after we take WM and the State/Jail/Sheriff, et al for millions, or perhaps lives out of state already but is licensed to practice there, Please refer them to my case. I almost died, and while in jail, I was really burglarized (they took everything I owned) and my mother died...I lost everything, including my once solid mental and physical health, and I'm not out of the woods yet. There were two guys detained in the back of a casino against their wills, and they got over a million each, and that was for only a few hours of their lives....I lost much more than the year I will never get back again...but I don't want to get rich off this, I just want to get my health back and have the few things I need..everything else will go to charity....I want to help children with cancer....innocent babies who've never done anything wrong, dying because of chemical polluters, perhaps....whatever the reason, I know how to help, Naturally....and this has always been my pet peeve. With this money, I could do something about it. I've hit legal sites, explained my cases to attorney websites, called Las Vegas attorneys, and I'm getting nowhere.
