I was just informed it is against the law to be homeless in MS. Yes,a 70 year old lady who was homeless ran out of gas in southaven she was told to push her car to a parking spot....she had just coasted into the gas station.anyways 70 yrs old,she was crying when the policeman dropped her off over the stateline road into memphis TN!!

What can be done?

    I really can't give out this source yet...I'm asking though,did u know it was against the law in MS ? Are there other states where it is illegal to be homeless?

      I don't believe that it is. That's why I asked where you got the information. Perhaps if you can't divulge your source, you could point me to the statute that is alleged to make it against the law?

      Generally, status laws do not survive Constitutional scrutiny. Typically, areas that wish to use the criminal law to rid the area of homeless people enact statutes that make specific behaviors illegal, such as sleeping in public or sleeping in an automobile.

      A pox on the person who makes a 70 year old woman push her car and then drives her over the state line. Why didn't he take her to the Catholic Charities?

    Anyways go google homless in southaven ms....I'm working on this so I'm not giving a lot of 411 on this YETTT without dotting all my i's,but I would like yall's feedback on the law....
    I will tell u this,my step father... my pop is in a mission in memphis....which I do go visit once a week btw)...there is no shelter or mission here at all.

    M'k let me spell it out for u madame. It's my story u won't know anything yet. I'm asking for opinions on a homless law in MS. I'm trying to fig out what other peoples homless situations in their communities. I am wanting feedback...

      Holly, you're "asking for opinions" on a law that none of us have reason to believe exists. I looked for it and didn't find it. You asked "what can be done?" That's a question I might be able to answer if I knew what law was in play--I worked extensively with the homeless and other people in dire economic straits when I was with legal aid, when I ran a welfare advocacy clinic, and when I served on the board of directors of a crisis center for victims of domestic violence and sexual assault. Of course you don't "have" to "back up" anything that you say, but the fact that you choose not to divulge any information that would allow anyone to provide useful answers demonstrates something significant about your true intentions.

      As I said above, what is typically referred to as "criminalization of homelessness" is legislation prohibiting certain acts common to the homeless, NOT that it is "illegal to be homeless". From one of your own links:

      "The criminalization of homelessness takes many forms, including:
      • Legislation that makes it illegal to sleep, sit, or store personal belongings in public
      spaces in cities where people are forced to live in public spaces;
      • Selective enforcement of more neutral laws, such as loitering or open container
      laws, against homeless persons;
      • Sweeps of city areas where homeless persons are living to drive them out of the area, frequently resulting in the destruction of those persons’ personal property,
      including important personal documents and medication; and
      • Laws that punish people for begging or panhandling to move poor or homeless persons out of a city or downtown area."

      we are kind of splitting hairs here. It seems to me that there are not resources allocated to helping people, and therefore cities are trying to get them to go be someone elses problem. Then there is the factor that I have mentioned in other threads, that homeless people are not always a nuisanse to anyone. There are those who know where food is discarded at closing time, and they take it rather than it going into a landfill.

      For any individuals who would like to leave the homeless life behind, There ought to be some support system to help them help themselves. For those who are happy without the responsibilities of modern life, it ought to be evaluated whether they present a true danger to anyone.

      No, Agit8r, it's definitely not splitting hairs. It's an important distinction because the remedy for each approach is very different, and knowing exactly what is being criminalized is the first step toward figuring out how to attack those laws, or their application to certain populations. The overly dramatic language that misstates the legal reality does everyone a disservice by shifting the debate away from the real issue and toward one that has no practical impact because it's centered around the acceptability of something that doesn't exist. The most effective vehicle for change always involves a clear statement of the problem. Misdirection, however well-intentioned, hinders solutions.

      If a person has no home and it is against the law for said person to sleep on side walk of where his home was just foreclosed on and there is NO SHELTER in the town where he used to reside,hmmmmmm doesn't take rocket science to fig out what the hell is going on....

      Now travelosity...u are right,but don't WASTE your time splitting hairs with madamex she would call it subtracting one hair from another...which is something totally different....

    This all ties in with foreclosures to. I saaaaawear....this is not a formal courtroom or on the record media room....this is a PUBLIC forum where I can meet MANY different people from ALL walks of life. I don't HAVE to back up any kind of discussiuon I have with other regular people like yours truly

    How could somebody with a beating heart do something like that to someone....from what I'm hearing from some of my peeps around town I haven't even scratched the surface yet.....y'all be looking for my up coming posts!!! I have until jan. To fig this out...b4 I hit the books...

    Hey there mustn't be just one 70yr old lady homeless...there might be many others...here in India there is no such laws...Coz if homeinallessness been crimized here then 20% of whole country's population will be tagged criminals bcoz all they are homeless...

Some folks are gonna be held accountable...mark my words... now as for my intentions well let me just say,hunny I answer to one judge and his last name happens to be CHRIST. Now its truly wonderful for your credentials and all,but nobody asked for them. You are being a SNOB and u need to just get over urself bc MADAME X is no different from than me except for she is a made up person...there is no such madamx take your user name away and you have just another "jane" like myself....
