I've got a problem with a social network that limits my personal expression, because a forty-five second sound bite (that I purchased on iTunes) belongs to a record company.

When it comes to social networking to connect with friends and family, I feel this is an unfair policy. I do see how it is key to lessen commercial videos that use songs without permission.

However, I thought Facebook was a virtual living room where I could freely "play a CD" while telling a story to my friends and family. Facebook touts: my house, my rules. Touché.

I've written a diatribe on this at my blog: www.careysaysums.com. What do you think about this policy? Have you had a similar issue? Please share it here.

I've had an issue with the same thing on Youtube. They would mute my sound, while playing my video. I would sync them up. They stated because of copyright infringement, they had to remove the sound, and if you violated it more than a certain amount of times, they could terminate your account. Now, being that so many Youtubers use many artists' songs, they have placed an advertisement on the bottom of the video so that people can purchase it right on the spot, enabling the user to still place the song on the video. So, Youtube did their homework and realized how important it was for others to use artists' songs.

I'm sure Facebook is a bit "young" and maybe soon will realize that there is a way to utilize these songs, and yet, give credit to those artists. I hope that helped.

      Well put, Pasquella. Thanks.

I am ever amused at the notion that the rights of users of free services exceed the rights of private enterprises to establish and enforce the conditions under which those services can be used.

Sorry, but it's Facebook's playground and Facebook's toys...if you don't like their rules, you just have to play somewhere else.

"Ever amused"? Are you writing a 19th Century novel? That's exactly what I've said, and that's what I've done.

Hm...they're not limiting your right to personal expression (what a silly statement)--what on earth made you think that you had a "right" to have someone create an international forum as a vehicle for your "personal expression"? And then you think that, having created that free vehicle of personal expression for you, they are also bound to turn a blind eye and risk liability when you use their forum to violate the law?

      Yup...my sentiments exactly.

Yes, but say it in Latin.

It seems we've heard from Metallica. Would anyone else like to chime in?

Has anyone told Facebook about 'Fair Use'?

Fair use is a tricky thing to get right, and I'm sure that corporations would much rather err on the side of caution. You should also try to realize that songwriters/performers are among the most taken advantage of group in the entertainment industry and protecting their right to make money off of their product is a good thing in the long run. My opinion, so feel free to blast me for it...

I think all forms of collage should be outlawed as well. Who do artists think that they are?
