    It is about freaking time that the Ninth Amendment was incorporated against the states, as the framers of the Fourteenth Amendment intended.

    As a former federal prosecotor and current defense attorney, I have mixed feelings. We need prosecutors to get involved to an extent in the investigation without fear of getting sued. But I can tell you that not all prosecutors are straight arrows (though most are) and I would guess the Court will say they can be sued. Interesting issue!

      perhaps in cases when obvious criminal activity (like framing, obstruction of justice, etc.) presents itself only?

    All I know is that I'm supposed to have this high & mighty "freedom of expression," yet I can't even wear my hair down at work (nevermind talking politics or religion there!)

    I haven't read the opinion, but at a glance it seems accurate to say that there's no Constitutional right not to be framed--which is a different issue entirely from whether there is or should be a cause of action on grounds other than Constitutional. I'm sure I'll have more to say on this subject once I've read the opinion, but "wrong" and "unconstitutional" are hardly synonymous.

      There must have been a ruling from either the state supreme court or a federal district/appellate court. I'm on my way out now, but will definitely be digging deeper into this later.

    I give a damn,that there isn't an amendment in the constitution "prosecuters have the right to frame whomever they want,for a crime" UM NO!!!! That isn't what the constituion was written for! DUHHHHH an abuse of power...I don't think so!!! Damn politicians
