U.S. Army Maj. Stefan Frederick Cook, set to deploy to Afghanistan, says he shouldn’t have to go.

His reason?

Barack Obama was never eligible to be president because he wasn’t born in the United States.

Cook’s lawyer, Orly Taitz, who has also challenged the legitimacy of Obama’s presidency in other courts, filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector for her client.

Conscientious objector because he doesn't like his Commander-in-chief? The guy should be court marshalled for anti-American activities and go to prison for a few years.

    Oh jeezum crowe. I fully support the right to object to military deployment based on a lot of things, but that is NOT one of them

    I wonder if when you're at work you can decide not to do your job because you dislike your boss' haircut, or argue that he can't have the job because you don't think he's a citizen (even if he was born in the states), or simply dislike your boss in general, and still not get fired....

      As a soldier, he has not only the right, but the responsibility to question or if neccesary refuse an order that he believes to be illegal.

      Any soldier who honestly believes that Obama isn't the president has a responsibility to refuse any order that carries out a command given by him. The risk here is that he has to make that distinction for himself, he has the right to countermand a superior officer that is issuing an order from a higher position that is illegal.
      He has to do this at his own peril, should there be no reason for his refusal, then he will face the ramafications.

      He is not refusing to do his duty because he believes that Obama is breaking the law. He is refusing because he doesn't like Obama.

    Edited to add: I see he's a reservist. While the law and truth are not on his side, I would not want someone like that commanding any American troops. One solution would be to cashier him, as he is clearly unfit for service, certainly in a politically sensitive location like Iraq. And maybe that's his aim. Maybe this is just his lame way of getting out of serving, even though he has a reservists commission. A discredit to both the military and conscientious objectors.

      Yeah, I don't think you should join the millitary and then become a consientious objector MS. You gave your word and that should mean something. As for the draft, it makes no sense in wars that have air power, as groups are smaller, meaning both you need fewer troops and you need better troops. I think you're right though about his intentions. Officers are smarter then this, and pretending to be unfit to evade service is a practice going back millenia.

    Also he should be made to pay back any salary he has received while serving, under false pretences, as reservist.

    UPDATE: The Army has revoked the deployment orders for a soldier who said he shouldn't have to go to Afghanistan because (he believes) Barack Obama was never eligible to be president.

    Because he's a reserve soldier who volunteered for an active duty tour he can "ask for a revocation of orders up until the day he is scheduled to report for active duty," a public affairs officer explained. Cook volunteered for the tour in May of this year. It is not clear why he did so, considering his current objections.

    Turns out that it was a political stunt to promote the lie that the Obama presidency is illegal. There are rumors out there (hopefully true) that Cook was fired from his job at a defense contractor under pressure from the DOD.

    Well, regardless of what you think about Cook, it is very strange that the Military revoked his orders at the last minute. They give no explanation or reason. Odd.

    Also, whether you believe Obama to have been born in Hawaii or not, there are an awful lot of cases going to court about this:

    * New Jersey attorney Mario Apuzzo has filed a case on behalf of Charles Kerchner and others alleging Congress didn't properly ascertain that Obama is qualified to hold the office of president.

    * Pennsylvania Democrat Philip Berg has three cases pending, including Berg vs. Obama in the 3rd U.S. Circuit Court of Appeals, a separate Berg vs. Obama case alleging he wasn't qualified even to be U.S. senator and Hollister vs. Soetoro a/k/a Obama, (now dismissed) brought on behalf of a retired military member who could be facing recall to active duty by Obama.

    * Leo Donofrio of New Jersey filed a lawsuit claiming Obama's dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.

    * Cort Wrotnowski filed suit against Connecticut's secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.

    * Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public's support.

    * Chicago lawyer Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama's vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.

    * Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama's eligibility could be confirmed, alleging doubt about Obama's citizenship. His case was denied.

    * In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.

    * Also in Ohio, there was the Greenberg v. Brunner case which ended when the judge threatened to assess all case costs against the plaintiff.

    * In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama's citizenship. The case was denied.

    * In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama's birth certificate. His request for an injunction against Georgia's secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.

    * California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters. She also has brought forward several other cases and has conducted several public campaigns to generate awareness of the issue.

    * In Texas, Darrel Hunter vs. Obama later was dismissed.

    * In Ohio, Gordon Stamper vs. U.S. later was dismissed.

    * In Texas, Brockhausen vs. Andrade.

    * In Washington, L. Charles Cohen vs. Obama.

    * In Hawaii, Keyes vs. Lingle, dismissed.

    In addition, other cases cited on the RightSideofLife blog as raising questions about Obama's eligibility include:

      Did you notice that all of those cases were dismissed or denied? That's what they do with frivolous cases that have no business wasting the court's time.

      Unless people really believe that the entire country's system of courts and higher courts are in the grips of a massive conspiracy to illegally elect a non citizen to the position of president.

      He provided his birth certificate in full to those who needed it, and provided a copy online for citizens to view for themselves. Even factcheck checked out the actual copy and garnered this rumor to be a propaganda stunt.

      I don't think anticrocks cares about minor details like that, Anok. His logic is that because law suits have been attempted, they must be valid, or, in other words, because conspiracy theories exist, they must be true.

      But I'm glad to realize just how prone to conspiracy theories he is. I really need not waste my time further.

      In all fairness, the 9/11 conspiracies were all brought to the court and also caused quite a stir.

      Doesn't mean that they're valid in any way shape or form.

      The whole "he's not a citizen" propaganda was part of a larger smear campaign (along with the posting of the alleged nude pictures of his mother) just as his campaign was picking up steam.

      Not one other presidential hopeful has ever been accused of not being a citizen. Not one. Not even brought up during their campaign - for all we know we could have elected several non citizens. *shrug*

    This is a question around the fundamentals of not only his eligibility, but directly related to the constitutional process.

    That so many are happy with factcheck.org in handling such a case as opposed to seeing it properly vetted in a court is disheartening to say the least.

    Maybe we should just surrender all legislative processes to websites and blogs.

    I've said it before, I doubt there is any merit in this, but the administrations boneheaded refusal to produce the ONE document that would end any more speculation, the vault copy itself. Is if nothing else a bit of a wonder.

    As far as a hawaiian Birth certificate it is a fact that HI issues COLB's to people who were not born in Hawaii. (Dr. Sun Yat-sen for instance) So the COLB that was provided as "evidence" is NOT prima facie evidence admissable in court.

    I still wonder why BHO is electing to spend several hundred thousand dollars in legal fees to avoid showing the real thing.

    What that says about his Open and transparent policies is another issue.

      There is no such thing as a "vault copy" of a birth certificate!

      There is your birth certificate with a seal, and that's it. You can get as many copies of as you want. They all come form a vault or safe from your local town hall where you were born.

    Maybe I'm alone in this, but I think that this entire conspiracy surrounding President Obama's citizenship is born out of racism. That is the only logical conclusion that can be made out of this insanity.
